Alaska Psychiatric Institute (API) Court Order

A court ruling issued by Anchorage Superior Court Judge William Morse on Oct. 21 required DHSS to submit a plan to the court regarding the detainment of people on civil psychiatric holds in correctional facilities by Dec. 5, but that date has now been extended to Jan. 13. The plan must address several systemic issues with Title 47 holds, including that of respondents being held by the Department of Corrections  pending transfer to a designated evaluation and treatment  facility. The court has ordered DHSS to implement the plan in 90 days or provide a clear explanation of what parts of the plan cannot be implemented in 90 days and an estimate of how long it will take those parts to be implemented. Thank you to behavioral health providers, emergency department physicians and psychiatrists who have been meeting with us and discussing with us.
